TERMS AND CONDITIONS FOR INSTAGRAM PRIZE GAMES
By participating in the giveaways & prize games on the pages www.instagram.com/koos.hotel.apartments and www.instagram.com/koos.bowls.bar, participants agree to the following terms and conditions:
§1 General
Participation in the giveaway on the Instagram page of KOOS Hotel GmbH is only possible under these terms and conditions. The giveaway is not affiliated with or supported by Instagram in any way.
§2 ELIGIBILITY
Participation is open to all natural persons who are at least 18 years old and have full legal capacity. Employees of KOOS Hotel GmbH and their relatives are excluded from participation. By participating, the participant agrees that their name and/or image may be published on the internet in the event of a win. Participation is only possible within the period specified in the giveaway description and in the manner specified (usually by commenting on the post). Multiple comments will be counted as a single entry, with only the first comment being considered. Legal recourse is excluded.
§3 PRIZE
The prize will be awarded as described in the giveaway. In the case of multiple correct entries, the winner will be selected by a random draw, with no legal recourse. The prize cannot be paid out in cash or exchanged. The prize claim is non-transferable. The winner will be determined no later than one week after the end of the giveaway and notified as described in the giveaway. If the winner does not respond within the time frame we set in the prize notification, the prize will be forfeited without replacement.
§4 LIABILITY
Claims for damages against KOOS Hotel GmbH in connection with the giveaway are excluded to the extent permitted by law, regardless of the legal basis, unless KOOS Hotel GmbH has intentionally or grossly negligently violated legal obligations. KOOS Hotel GmbH is also not liable for damages resulting from technical disruptions, acts of nature beyond control, or third-party attacks on the giveaway website. However, KOOS Hotel GmbH will take all reasonable measures to ensure the reliability and functionality of the giveaway website. Furthermore, KOOS Hotel GmbH does not guarantee that the giveaway website will function properly on the participant’s device.
§5 DATA PROTECTION
KOOS Hotel GmbH ensures the highest possible data protection standards during the giveaway and complies with all relevant legal regulations. No personal data will be passed on to third parties or sold. KOOS Hotel GmbH will store the personal data of participants solely for the purpose of conducting the giveaway. §6 SEVERABILITY CLAUSE
Should any provision of these terms and conditions be invalid or incomplete, the validity of the remaining provisions shall remain unaffected. In place of the invalid or missing provisions, a provision that most closely reflects the purpose of the agreement and the legal requirements shall apply.
§7 JURISDICTION / APLLICABLE LAW
In case of disputes, only German law shall apply. The place of jurisdiction is, as far as legally permissible, the registered office of KOOS Hotel GmbH. If the participant has no general jurisdiction in Germany or moves their residence abroad after participation, the place of jurisdiction shall also be the registered office of KOOS Hotel GmbH.
§8 SELECTION PROCESS
In the case of multiple correct entries, the winner will be determined by a random draw.
§9 EARLY TERMINATION OF THE PRIZE / GIVEAWAYS
KOOS Hotel GmbH reserves the right to modify, cancel, or terminate the giveaway without prior notice due to unforeseen circumstances. This applies particularly if technical or legal reasons prevent the regular and proper execution of the giveaway.
